By accessing or using the Website, including any content, functionality, and services offered on or through the Website (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not access or use the Website or Services.

These Terms form a binding legal agreement between you ("you" or "User") and InspectHomeNow Private Limited. Please read these Terms carefully. These Terms incorporate by reference our Privacy Policy, Cookies Policy, Website User Policy, and Disclaimer (available on the Website). Capitalized terms used herein but not defined shall have the meanings ascribed in those policies.

1. Eligibility

Persons who are "incompetent to contract" under the Indian Contract Act, 1872 (e.g., minors, persons of unsound mind, or undischarged insolvents) are not eligible to use or access the Services. You must be at least 18 years of age or the age of majority in your jurisdiction (whichever is higher) and possess the legal capacity to enter into these Terms.
By using the Services, you represent and warrant that:

• You meet the eligibility criteria.
• You are not barred from receiving the Services under applicable laws of India or any other jurisdiction.
• If using on behalf of an entity, you have the authority to bind that entity.

We reserve the right to terminate your registration, refuse access, or suspend Services if we discover non-compliance, suspect violation through usage patterns, or if required by law. We may verify eligibility at any time.

2. Description of Services

InspectHomeNow, leveraging the expertise of its parent company Ads Lab Technologies (a NABL-accredited laboratory for material testing since 2014), provides technology-enabled visual property inspection services across India. Services are limited to non-invasive, visual assessments for general overview and viability (e.g., purchase, lease, renovation). Key Services include:

• Comprehensive Home Inspections: Visual checks for structural integrity (foundations, walls, roofs), electrical/plumbing systems, HVAC, safety features, and compliance indicators with National Building Code of India, 2016 (excluding exhaustive code verification).
• Interior Design Consultations: Advice on space optimization, materials, and aesthetics, including virtual 3D models.
• Re-inspections and Follow-up Reports: Verification of remedied defects with photographic/video evidence; free telephonic consultation up to 1 month post-report.
• Dampness and Moisture Inspections: Thermal scanning and moisture metering for water ingress, mold risks (excluding air quality or mold lab testing).
• Multi-Stage Inspection Processes: Phased audits for new builds, resales, or commercial spaces, including pre-purchase, mid-construction, and post-occupancy.
• Accurate Area Measurements: Laser surveying for floor plans, carpet area, and RERA-compliant calculations.

Inspections exclude: geologic/soil analysis, indoor air quality/mold lab tests, heat exchanger/electrical circuitry diagnostics, plumbing pressure tests, underground utilities/easements, full structural engineering, water leakage simulations, land surveys, firefighting systems, material lab testing, pests/termites, radon, seismic risks, flood/noise hazards, insurability, or development potential. Services are not technically exhaustive; reports are factual visual aids "as is where is," not opinions on builder reputation or construction quality.

Services may include a 360-degree virtual tour link (valid 1 month) and email queries (up to 1 month). Reports are proprietary to InspectHomeNow; for your sole use in rectifications, not public sharing or unqualified reliance. Status reflects inspection date only. You may appoint specialists for deeper checks; we defer liability to them. All Services subject to availability, geographic limits (major Indian cities), and scheduling via Website/app/phone/email.

We reserve the right to modify, suspend, or discontinue Services without notice, subject to refunds per Section 4.

3. User Accounts

Registration and login are required for bookings, reports, and tracking. To create an Account:

• Provide accurate, complete, current information (name, email, phone, address, demographics).
• Consent to promotional/transactional communications via SMS, email, WhatsApp, calls (notwithstanding DND).
• Enable two-factor authentication.

You agree to:

• Update information promptly.
• Maintain confidentiality of credentials; responsible for all activities under your Account.
• Notify us immediately of unauthorized use via contact@inspecthomenow.in.
• Use only your own credentials; no sharing.

We do not store full payment details (handled by gateways). We may monitor for compliance, change identifiers, or suspend/terminate Accounts for breaches, fraud, inactivity (12 months), or legal reasons. Upon termination, access ends; data may be retained per Privacy Policy. You acquire no ownership rights in Account identifiers.

4. Fees and Payments

Fees ("Inspection Fees") are listed on the Website/Pricing page and vary by property size, type, location, and add-ons. Fees accrue from booking confirmation; 100% advance payment required via secure gateways (e.g., Razorpay, UPI, cards). We do not store card details.

• Refunds/Cancellations: Refunds are processed based on the stage of service at the time of cancellation request. All refunds will be processed within 7-10 working days via the original payment method; processing times may vary due to banking delays, and no guarantees are provided. Refunds are at our sole discretion and subject to verification. Additional charges may apply for any preparatory costs incurred (e.g., travel for site visits if canceled late).
• Cancellations requested prior to the initial consultation: Full (100%) refund without any deductions or questions.
• Cancellations requested after the initial consultation but before the site visit is scheduled by InspectHomeNow: Full (100%) refund.
• Cancellations requested after the initial consultation, site visit scheduled by InspectHomeNow, but before the site visit commences: Full (100%) refund.
• Cancellations requested after the site visit has commenced but before the physical inspection is completed by the engineer: 50% refund (50% deduction for preparatory and partial execution costs).
• Cancellations requested after the physical inspection has been fully performed by the engineer: 25% refund (75% deduction for full service execution, including report preparation). No refunds for no-shows, late cancellations without prior notice, or after report delivery. Subscription-based services follow similar tiering unless specified otherwise.
• Taxes/Extras: Fees exclude GST (18%), surcharges, or taxes you pay. Late fees at 1.5% monthly.
• Auto-Renewals: For subscriptions (e.g., annual audits), auto-renew unless canceled; opt-out via Account.
• Disputes: Raise within 7 days; resolved per Dispute Resolution.

Fee changes effective upon posting; continued use accepts them.

5. Intellectual Property

All Content (text, software, images, videos, designs, reports, 360-views) is owned by InspectHomeNow, Ads Lab Technologies, or licensors, protected by Copyright Act, 1957; Trademarks Act, 1999; and international laws.

• License: Limited, revocable, non-exclusive, non-transferable right to access/use for personal, subscribed purposes.
• Restrictions: No reproduction, modification, distribution, derivative works, scraping, or commercial use without written consent. No reverse engineering.
• User Content: Submitted materials (photos, feedback) grant us perpetual,

royalty-free, worldwide license to use/modify for Services/promotions. You warrant ownership/non-infringement; retain rights but waive moral rights.

Infringement notices to contact@inspecthomenow.in; we may remove content.

6. User Conduct and Prohibited Activities

Use Services lawfully, ethically, and per instructions. Provide accurate data; obtain consents/permits at your cost. Comply with taxes, costs, and laws. Keep credentials confidential; log out after use. Grant us rights over your displayed data.

Prohibited:

• Unlawful/fraudulent use (e.g., false info, impersonation).
• Harmful content (defamatory, obscene, harassing, infringing IP/privacy).
• Interference (viruses, hacking, DoS, scraping).
• Unauthorized access/sharing; commercial resale.
• Offensive/abusive posts; threats; spam.
• Violating security; introducing malware.

We may delete content, suspend access, pursue remedies (including indemnity). Report breaches immediately.

7. Third-Party Links and Services

Links to third parties (e.g., gateways, maps) are for convenience; no endorsement. Use at your risk; their terms apply. No liability for their content/actions.

8. Disclaimers

Services/Website "AS IS" without warranties (express/implied) of merchantability, fitness, non-infringement, or completeness. Reports are visual aids, not exhaustive; no detection guarantee for hidden/invasive defects. No warranty on accuracy/reliability; may contain errors (correctable without notice). No RERA compliance guarantee; verify independently. Not for unqualified reliance; consult experts. No liability for future issues, missed defects, or third-party info (e.g., builders).

9. Limitation of Liability

To maximum extent, we/affiliates/agents not liable for indirect, incidental, consequential, punitive damages (e.g., lost profits, data) from Services/use, even if advised. Direct liability capped at Fees paid in prior 12 months. Excludes invasive testing defects, malfunctions post-inspection. Some laws limit this; check applicability.

10. Indemnification

You defend/indemnify us/affiliates from claims/damages/costs (including fees) from your breach, misuse, user content, or third-party disputes. Survives termination.

11. Governing Law and Dispute Resolution

Governed by Indian laws (no conflicts). Disputes: Informal resolution via contact@inspecthomenow.in (30 days). Else, arbitration under Arbitration & Conciliation Act, 1996, in Ghaziabad (English; we appoint arbitrator; binding). Courts in Ghaziabad have exclusive jurisdiction.

12. Changes to Terms

We may update Terms (e.g., for laws/tech); posted with date. Material changes notified (email/notice). Continued use accepts; else, stop. No liability for changes.

13. Termination

Breach auto-terminates access. We may suspend/terminate without notice/liability. Obligations survive (e.g., payments, indemnity).

14. Miscellaneous

• Entire Agreement: Supersedes priors; incorporates policies.
• Severability: Invalid provisions severed.
• Waiver: Written only; no delay waives.
• Assignment: We may; you cannot.
• Force Majeure: Excused for uncontrollable events.
• Notices: Email/Website valid.
• No Association: No direct contact with our clients except via us.
